What happened?
The scope of the short-term let (STL) legislation in Scotland has been clarified to confirm that home exchanges are not included under this regulation.
Section 3.3 now states that “no license is required where the home exchange is not carried out as part of a commercial activity.”
This means that our Scottish members can continue exchanging their homes without needing to apply for a license.
This outcome is the result of the dedicated efforts of our members, our team, and our advisors over the past few months. We are thrilled that, following constructive dialogue, the Scottish Government now acknowledges the unique nature of home exchanging compared to the short-term rental sector.
What should you do now?
As a Scottish member, if you have already applied for (and paid for) a license, you should contact your local authority to arrange a refund.
